In this putative class action case, plaintiffs have filed a motion for class certification contemporaneously with their complaint. Presumably, plaintiffs have done so in order to address the concerns raised by the Court of Appeals in Damasco v. Clearwire Corp., 662 F.3d 891, 897 (7th Cir. 2011). At this time, however, consideration of the motion is premature. Accordingly, the Court asks that the parties consider entering into a stipulation in this case that would obviate the need for the parties to address the premature motion for class certification, while also addressing the mootness concerns raised in Damasco. See, e.g., Hayden v. Fresh Express, Inc., Case No. 12 C 1583 [doc. no. 18]. The parties are instructed to report whether they are amenable to agreeing to such a stipulation at the next status hearing. Initial status hearing set for 7/1/15 at 9:00 a.m. The parties are directed to file an initial status report as set forth in the Judge's standing order four business days prior to the status hearing.
