The Court asked Plaintiff's counsel about the amount in controversy for diversity-jurisdiction purposes. Plaintiff's counsel alleged that Plaintiff suffered back and neck injuries, and also suffered post-trauma stress that caused permanent hair loss. In view of those allegations, the Court holds that the jurisdictional amount-in-controversy has been satisfied. Rule 26(a)(1) disclosures due by 02/01/2016. First-round of written discovery requests must be issued by 01/18/2016. Fact discovery, including treating medical care providers, to close by 01/04/2017. The Court discussed with the parties that this is a rather long discovery period, and the Court will monitor progress; it is true, however, that there are 6 treating physicians, and the defense likely will investigate pre-accident medical condition, raising the possibility of more medical-care provider witnesses. Parties shall submit proposed HIPAA orders and confidentiality orders promptly. The parties are discussing settlement, which the Court certainly encourages. If the case does not appear to be settling early, then the Court will set deadlines for serving subpoenas at the next status hearing; the goal is to ensure gathering all necessary records as early as possible both to help settlement discussions and, short of that, to make the discovery deadline.
