Kennelly: On May 20, 2020, the Court dismissed Plaintiff's case with prejudice for failure to comply with the CMO 126 obligations of paragraphs B.9 and B.10. The Court directed Plaintiff's counsel (Brandon H. Steffey) to immediately advise Plaintiff in writing of the dismissal of the case and certify on the record compliance with that directive. In addition, the Court ordered Plaintiff's counsel to show cause in writing by May 26, 2020, why the Court should not impose a sanction for failure to certify that he advised Plaintiff in writing of the Court's 4/21/2020 order, as the Court directed in that order. Plaintiff's counsel did not comply with either directive. On July 3, 2020, the Court issued an order giving Plaintiff's counsel until the close of business on July 13, 2020 to comply with both directives and certify that he had done so. The Court stated that it would impose a sanction if Plaintiff's counsel failed to comply. To date, Plaintiff's counsel has not complied. The Court imposes upon Plaintiff's counsel Brandon H. Steffey a monetary sanction in the amount of $1,000, payable to the Clerk of the Court, for his knowing failure to comply with court orders. See, e.g., Fuery v. City of Chi., 900 F.3d 450, 463 (7th Cir. 2018) ("A court may use its inherent authority to sanction those who show willful disobedience of a court order...." (internal quotation marks omitted)); see also Nwatulegwu v. Boehringer Ingelheim Pharm., Inc., 668 F. App'x 173, 175 (7th Cir. 2016) ("Strict adherence to case management orders is necessary to manage multidistrict litigation...."). The Court will vacate this order and sanction if counsel establishes compliance with the Court's previous orders via a sworn affidavit to be filed no later than August 14, 2020.
