- ilnd;;1:16-cv-01343_de20 RegisterActionDescriptionText "MINUTE entry before the Honorable Matthew F. Kennelly: On 4/21/2020, the Court extended Plaintiff's time to respond to CMO 168 for reasons stated on the docket. The Court noted that the extra time was not subject to further extension for any reason. The Court also directed Plaintiff's counsel to immediately advise Plaintiff in writing of the 4/21/2020 order and certify on the record compliance with that directive. Neither Plaintiff nor Plaintiff's counsel has filed anything in response to the 4/21/2020 order. Plaintiff having failed to either (1) file a stipulation dismissing the AbbVie Defendants with prejudice, or (2) show cause in writing why this case should not be dismissed under CMO 126, paragraph B.11, made applicable to AbbVie Defendants via CMO 143, as ordered by the Court on 2/13/2020, this case is dismissed with prejudice for failure to comply with the CMO 126 obligations of paragraphs B.9 and B.10 by the deadline set forth in the Court's 4/21/2020 order. The Clerk is directed to enter judgment dismissing the case with prejudice. Counsel is to immediately advise Plaintiff in writing of the dismissal of the case and certify on the record compliance with this directive within 7 days of entry of this order. Plaintiff's counsel is also directed to show cause in writing, by no later than 5/26/2020, why the Court should not impose a sanction upon counsel for the failure to certify that he or she notified Plaintiff in writing of the Court's 4/21/2020 order. MDL member case terminated. Mailed notice. (mma, ) (Entered: 05/20/2020)" @default.
