Defendants state that because the Court rejected Plaintiff's claim that the bottle and its destruction are not relevant any longer. Plaintiff asserts that the unique size of the bottle is relevant to their theory of the case in that it connects Robert LaGace to the crime and because it was found with the murder weapon. Defendants' motion 512 is denied. The bottle and the fact that the fingerprints are not available are relevant and not overly prejudicial. Of course, Plaintiff shall not argue that there was any wrong doing in relation to the bottle based on the Court's previous ruling and the Court will entertain a proposed jury instruction that tells the jury that they cannot assume that there was destruction of evidence merely because the item is not before the Court.
