- ilnd;;1:16-cv-01963_de705 RegisterActionDescriptionText "MINUTE entry before the Honorable Virginia M. Kendall. Defendants seek to bar any witness, and specifically Plaintiff's DNA expert, Charlotte Word, from offering her lay opinion based on "common sense" that the knife could not cause the cuts in Trunko's clothing or body 523 . She opined that the width of the blade was too wide to cause the cuts found in Trunko's clothing and that the knife could not have penetrated to the depth of the hilt if it was the murder weapon. Word is not an expert in knife wounds, has no experience measuring knife wounds, and her focus was not on comparing the knife to the openings in Trunko's clothing. It would be highly prejudicial for her to cross over from her expertise in DNA to offer an opinion not based in her training or experience and therefore her common sense statements shall be excluded. This is not to say, however, that in closing argument the parties would be barred from making any "reasonable inference" based on the admitted evidence so long as that inference is reasonable and based on the evidence admitted at trial. Motion 523 is granted. Mailed notice (lk, ) (Entered: 11/23/2020)" @default.
