Defendants seek to exclude any post-conviction serological and DNA test results arguing that the length of time since the original testing and the lack of precautions in maintaining a clean chain of custody make the test results unreliable to the level of being prejudicial to their defense 519 . Defendants claim the test results are not relevant to the issue at hand. Plaintiff counters that the evidence goes to his innocence and that any attack on the evidence goes only to the weight that the jury gives to the evidence. There is no question the DNA test results are relevant especially in light of the Defendants' defense which is that Plaintiff is actually guilty of the murder. The question is whether the Jury can properly afford what weight it deems appropriate to that evidence. The Court is confident that it can. The Jury will have the benefit of a number of DNA experts who can explain their results and how they reached them. The Defendants will have every opportunity to cross these experts regarding the potential contamination that may have come from the handling of the knife over all of these intervening years.
