Defendants seek to admit Plaintiff's disciplinary record in prison to mitigate the damages in this case 525 . Plaintiff objects calling this evidence impermissible 404(b) evidence and not relevant. The Court sees little relevance to infractions in prison for which Plaintiff may have been disciplined with one exception. If Plaintiff were to testify that he was suffered in solitary confinement and that solitary confinement was based on his own infraction and would not have occurred but for his infraction, then that would be permissible. If an average prisoner would not be placed in that type of confinement unless he violated some prison rule, that infraction would be relevant to explain why he was in solitary confinement. On the other hand, many prisoners are being placed in solitary confinement currently due to COVID-19 and one could hardly blame an inmate for that type of confinement due to the pandemic and the need to prevent the spread. Therefore, defendants must be able to present to the Court that a particular infraction caused a particular type of confinement. Provided they do so and provided that Plaintiff testifies that this type of confinement was unusually difficult and worthy of the Jury's attention when determining the value of making him whole, Defendants will be permitted to show the jury that Plaintiff did not need to be placed in that confinement but he was due to his own actions.
