Plaintiff does not state the Federal Rule of Civil Procedure under which he seeks reconsideration of this Court's final judgment in favor of Defendants. However, to the extent Plaintiff brings a motion to alter or amend a judgment under Rule 59(e), such a motion is denied as untimely because it was filed on June 19, 2020, which is more than 28 days after the Court entered its final judgment 240 on March 13, 2020. Further, the deadlines for Rule 59(e) motions were expressly excluded from the automatic extensions afforded under Amended General Orders 20-0012. And while a motion under Rule 60(b) need only "be made within a reasonable time," Fed. R. Civ. P. 60(c)(1), the Seventh Circuit has held that "Rule 60(b) relief is appropriately denied when a party fails to file a timely appeal and the relief sought could have been attained on appeal." Mendez v. Republic Bank, 725 F.3d 651, 659 (7th Cir. 2013). Plaintiff has not noticed an appeal in this matter and the 30-day period for doing so under Federal Rule of Appellate Procedure 4(a)(1)(A) has long since passed. That deadline was also expressly excluded from the automatic extensions granted under Amended General Orders 20-0012. Here, Plaintiff's motion for reconsideration is addressed entirely to issues that were correctable on appeal. For that reason, Plaintiff's motion for reconsideration is also denied to the extent it is brought under Rule 60(b). Finally, the Court notes that Plaintiff has a history of filing motions in connection with this action with no apparent basis in the Federal Rules of Civil Procedure and largely rehashing the same arguments concerning the loss of Plaintiff's personal effects from his locker.
