The government's response is due by March 1, 2021. Among other things, the government should address whether it views Maldonado as an expert witness within the meaning of Rule 26(a)(2)(A). Also, it appears that Plaintiff did not depose Maldonado. The motion requests leave to depose him, but Plaintiff does not frame it as a request to re-depose him. The government should address whether it opposes a request to depose Maldonado. By February 24, 2021, Plaintiff must file a statement and address the following questions: Did Plaintiff ever depose Maldonado, and if not, why not? It may be true that the government did not disclose Maldonado as an expert witness. (Put aside for the moment whether Maldonado is, in fact, an expert witness.) But the government did disclose him as a fact witness in March 2018, almost three years ago. The disclosure stated that he had knowledge that "appropriate procedures were followed." So, he professed to have personal knowledge as a fact witness about (1) what the procedures were; (2) why they were appropriate; and (3) whether they were followed in this particular case.
