- ilnd;;1:18-cv-03501_de7 RegisterActionDescriptionText "ORDER: Plaintiff filed this suit without prepaying the $400 filing fee or submitting an application to proceed in forma pauperis ("IFP") to pay it with monthly deductions from his prison trust account. Additionally, his claim consists of one sentence: "all 3 Staff got caught by staff, me, & inmates looking thru my outgoing legal mail in Nov. 2017." (Dkt. 1, pg. 6.) A complaint need not state extensive details, but it must state enough to "raise a right to relief above the speculative level." Bell Atl. Corp. v. Twombly, 550 U.S. 544, 555 (2007). Simply asserting that Plaintiff's legal mail was opened outside his presence once or a few times does not present a valid claim. Guajardo-Palma v. Martinson, 622 F.3d 801, 805 (7th Cir. 2010) (a practice of opening mail between an inmate and his attorney outside the inmate's presence may support a constitutional claim, but one or two incidentsabout which the complaint's allegations are extremely vaguedoes not). The complaint is thus dismissed. To proceed with this case, Plaintiff must: (1) either prepay the $400 filing fee or submit an IFP application to pay it with monthly deductions from his prison trust account, and (2) submit an amended complaint that states a valid federal claim. His failure to comply by August 6, 2018 will result in dismissal of this case. The Clerk shall send a blank IFP application and an amended complaint form to Plaintiff. Signed by the Honorable Frederick J. Kapala on 7/6/2018. Mailed notice (kms) (Entered: 07/06/2018)" @default.
