Plaintiff requests that the Court alter its ruling on defendant's motion to dismiss and allow her 30 additional days to file an amended complaint. Defendant contends that plaintiff did not file her motion timely. This motion was filed pursuant to Rule 59(e), which allows 28 days to file a motion to alter a judgment. While the Court issued its order dismissing the complaint 47 on 7/11/2019, the Court entered final judgment on 8/29/2019 50 , after plaintiff did not file an amended complaint within 30 days of the Court's order. Therefore, plaintiff's motion was timely. The timing issue, however, does not alter the outcome. Although plaintiff filed several new exhibits, plaintiff has not presented any intervening changes that would support the Court altering its judgment. For the same reasons, if plaintiff had brought a similar motion under Rule 60, as plaintiff argued in Court, the outcome would be the same. Further, the Court notes that plaintiff did not file a timely amended complaint to cure the deficiencies addressed in the Court's order dismissing the complaint 47 . The Court clearly required that plaintiff file any amended complaint within 30 days of the Court's 7/11/2019 order 46 . Plaintiff did not comply with this order. Throughout this matter, the Court has granted plaintiff many extensions that have been expressly communicated to plaintiff, including two extensions of time to serve defendants and four extensions of time to file an amended complaint. Plaintiff has not demonstrated excusable neglect, or any reason, for failure to comply with the Court's deadline. There is no reason for the Court to provide exception to its 7/11/2019 order regarding the time allowed to amend the complaint. Therefore, the Court denies plaintiff's motion to alter judgment 53 .
