Chang: Telephonic motion hearing held on standby counsel's motion to withdraw 222 and status hearing on other issues. Defendant is in custody and appeared by telephone. 1. As discussed during the hearing, the trial will be held in Courtroom 2541, because distancing requirements made other courtrooms infeasible at this point. The extensive efforts to set up and to program necessary technology for juror display and sidebar headsets precluded programming headsets for standby counsel and Defendant. But a chat function on secure computers has been arranged. The Court will separately email the parties and counsel with details about the setup. Also, the lawyers should arrive in Courtroom 2541 at 8:30 a.m. on 08/03/2020 to view the setup more generally. Standby counsel's motion to withdraw is entered and continued until then. For the parties' further information, the MCC reports that Defendant will be tested for the coronavirus on the first day of trial and then every 48 to 72 hours thereafter, and also will be checked for symptoms daily (as previously noted, he will be on quarantine during the trial and for 14 days thereafter). Although the Defendant will have access to a computer to review evidence even when quarantined, there is no staffing to accomplish an attorney-client call after the trial day. 2. Separately, as discussed during the hearing, the government has kindly agreed to display the defense exhibits upon request during the trial, purely as a courtesy and with no responsibility for the contents. The Court double-checked the JERS disc supplied by defense counsel. On that review, the one multi-page exhibit, DX 44, was properly supplied as multi-page exhibit. But the supplied file for DX 34 was the entire Bates range of 001 to 515, so the Court has replaced that with the proper single page, Bates 222. Also, the video clips for DX 22 were not needed (and did not appear to be the correct clips), because those are GX 76 and 78, as discussed during the pretrial conference. The file with the name "TBD" has been edited by the Court to 24_Report excerpt second 06-12-2019. The Court has made these corrections, and added Exhibit Number prefixes, and will give the government a thumb drive with the complete set of defense exhibits on Monday. 3. Next, on the proposed voir dire questions that Defendant described during the hearing, the Court holds that Question 14, R. 225-1, adequately covers the concerns underlying Defendant's proposed additional questions. Also, as previously noted, the Court will provide a strong, in-trial jury instruction on the irrelevance of the jury's agreement or disagreement with Defendant's beliefs. R. 201 at 6. So the additional questions are overruled. 4. Lastly, Defendant confirmed that he has no other video clip to offer other than GX 76 and 78.
