In its previous minute order 39 , this Court expressly stated that no further extensions will be granted. Moreover, in the last motion for extension of time, Claimant's counsel represented that: "It is hoped by the parties said depositions can be conducted in person within the next two months. If they cannot be conducted in person, the parties have agreed they will be conducted by video." (Dkt. 38 at 6.) Given this previous agreement, the Court does not believe that Claimant's counsel can now insist on conducting the depositions in person. Finally, although the Court is sympathetic to the fact that Claimant's counsel lives in California, which is one of the states subject to a mandatory 14-day quarantine period pursuant to the City of Chicago's Emergency Travel Order, the Court takes judicial notice that that has been true since July 6. Counsel had ample time to make necessary arrangements if in-person depositions were crucial to this case. Considering the potentially lengthy period during which California will likely remain subject to the City of Chicago's Emergency Travel Order, the Court does not believe that an open-ended discovery extension is appropriate. The fact discovery deadline of 8/31/20 remains. The parties may conduct the depositions remotely, as previously agreed. As planned, the parties are to file another joint status report by 9/1/2020 regarding the status of fact discovery, proposing an expert discovery schedule, and letting the Court know whether the parties want a settlement conference with Judge Cox at that time.
