By March 31, 2020, defense counsel shall inform the Court whether this case will proceed through an administrator of defendant O'Donnell's estate. Plaintiff's motion to substitute Defendant (Dckt. No. 56 ) is hereby granted without objection. The Court substitutes William G. Proctor, Jr., administrator for the Estate of William G. Proctor, Sr., for the deceased defendant William G. Proctor. Plaintiff's Motion to Appoint and Substitute a Special Representative for Deceased Defendants 7726C25, Kevin 6DAE1FE, and Eugene Jackson (Dckt. No. 58 ) is denied without prejudice. The Court and counsel discussed whether it is appropriate to appoint counsel for other defendants as the special administrator. The Court concluded that the preferred option, at least at the outset, is to explore the appointment of members of the defendants' families to serve as the administrators. The Court directs counsel to send a copy of the complaint and motion to substitute (Dckt. No. 56 ) to the family of the deceased defendants. Plaintiff's counsel shall contact the families of those three decedent defendants, and for each decedent, inquire whether there is an estate, who is the administrator of the estate (if any), and whether any family member would be willing to serve as an administrator if necessary. Plaintiff may re-file a motion for appointment of a special administrator, as necessary, at an appropriate time. If the members of the families are unable or unwilling to serve, the Court and the parties will explore other alternatives. At the appropriate time, defendants could raise their argument that any such appointment is time-barred, as discussed at the hearing. Before March 31, 2020, counsel for the City of Chicago shall notify Plaintiff's counsel whether there is an insurance policy that covers this case. Mailed notice.
