Among other things, PHH argues that the Court lacks subject matter jurisdiction over B1E2964 claims (with the exception of Count III) because her claims are barred under the Rooker-Feldman doctrine. The parties do not address whether Rooker-Feldman applies in a case such as this one, where B1E2964 filed her case after the entry of a judgment of foreclosure but while a state court appeal remains pending. The Court orders the parties to file supplemental briefs, not to exceed 5 pages, addressing: (1) the status of B1E2964 state court appeal; and (2) whether Rooker-Feldman applies when a federal suit is filed after the entry of a judgment of foreclosure but while a state court appeal is pending, specifically addressing the Seventh Circuit's decisions regarding Rooker-Feldman's applicability to interlocutory orders and decisions on appeal in Bauer v. Koester, 951 F.3d 863 (7th Cir. 2020); Carpenter v. PNC Bank, 633 F. App'x 346 (7th Cir. 2016); and Parker v. Lyons, 757 F.3d 701 (7th Cir. 2014).
