McShain: The Court has reviewed the plaintiffs' Notification to Court Regarding Audit Documents 43 , which states that defendant failed to upload to a shared drive the defendant's books and records, which plaintiffs' auditors need to complete the court-ordered fringe benefit fund contribution compliance audit 36 , by 10/02/2020, as plaintiffs had demanded. The Court observes that it found defendant in default on 06/25/2020, and ordered that defendant produce its books and record for the audit within twenty-one days of service of the default order. 36 1-2. Nevertheless, due in part to defendant's non-cooperation, the audit is now no nearer to completion that in it was when the Court first ordered that the audit take place. This Court has the "inherent power" to "impose sanctions short of dismissal for violations of court orders." State Farm Fire & Cas. Co. v. U.S. ex rel. Rigsby, 137 S. Ct. 436, 444 (2016). Moreover, the Court has "the inherent power to impose sanctions for abuse of the judicial system, including the failure to preserve or produce documents. This power is not based in rule or statute, but rather in the ability of the courts to manage their own dockets and ensure expeditious resolution of cases." Northington v. H & M Int'l, No. 08-CV-6297, 2011 WL 663055, *12 (N.D. Ill. Jan 12, 2011). "The sanction imposed should be proportionate to the gravity of the offense." Montano v. City of Chicago, 535 F.3d 558, 563 (7th Cir. 2008) (internal quotation marks and citations omitted). The Court orders that, no later than 10/30/2020, defendant shall produce and upload to the plaintiffs' shared drive all books and records that plaintiffs' auditors need to complete the audit that the Court ordered on 06/25/2020. If defendant fails to do so, the Court will consider whether to impose a sanction on defendant of $100 per day until such time as all necessary books and records are produced and uploaded. Because defendant is not represented by counsel, the Court further orders that plaintiffs shall (a) serve a copy of this order on defendant through its registered agent; and (b) file a certification on the docket attesting that service of such order has been accomplished.
