Second, Local Rule 40.4 does not govern pretrial coordinated discovery, only outright reassignment of cases. Internal Operating Procedure 13(e) is the proper way for one judge to handle coordinated discovery. In any event, this will give the Court a chance to direct a broader conferral that hopefully will result in efficiency and fairness for all four cases, because it is sensible for one judge to preside over all four cases: whether Defendant is liable or not should not vary from case to case given the factual circumstances (damages will differ, but not liability). Before Defendant refiles the motion, the Court directs defense counsel to confer with Defendant and with the lawyers for the plaintiffs in all four cases (19-cv-3243; 19-cv-3370; 19-cv-3898; and 20-cv-1351) on whether all parties in all the cases would consent to the jurisdiction (for all purposes, including entry of final judgment) of Magistrate Judge Cummings, who has the most experience in the cases. Of course, the parties have the right to say no without adverse consequences. But if the answer is yes, then Defendant may file the motion reporting the agreement of all the parties and asking for all the cases to be reassigned to Judge Cummings. The Executive Committee of the Court would then reassign Judge Cummings as the judge to preside over all four cases (for all purposes) under Internal Operating Procedure 13(d). If any party objects, then Defendant instead may file (after conferral with all the lawyers) a motion to assign Judge Cummings to handle coordinated discovery under Internal Operating Procedure 13(e).
