- ilnd;;1:20-cv-01792_de286 RegisterActionDescriptionText "MINUTE entry before the Honorable Matthew F. Kennelly: This order is entered by Judge Kennelly as emergency judge. Following consultation with Chief Judge Pallmeyer, Judge Kennelly will handle the emergency motion filed on the emergency docket (Case No. 20 C 1792, dkt. no. 253) and in US v. Jerrell Benford, Case No. 04 CR 888-4. Counsel are directed to immediately advise Judge Kennelly's courtroom deputy clerk whether either of them has a copy of the defendant's presentence report and the government's sentencing memorandum (if one was filed), as these documents do not appear on the electronic CMECF docket. If so, counsel should scan the report and memorandum and send them electronically to Judge Kennelly's courtroom deputy clerk. If not, the Court will do its best to attempt to obtain a copy of the presentence report for itself from the Probation Office. The government, which on 4/13/2020 designated an assistant U.S. attorney on this case, is directed to file a response to the defendant's motion by 4/17/2020. The defendant is directed to file a reply by the close of business on 4/20/2020. These filings should be made only in the criminal case, and not on the emergency docket, and copies should be provided by e-mail to Judge Kennelly's courtroom deputy clerk. Judge Kennelly will determine after reviewing the briefs whether a telephone hearing is needed. The clerk is directed to terminate the motion on the emergency docket. Mailed notice.
