The Defendant's emergency motion for release from detention due to the COVID-19 pandemic 44 (Dkt. 33 in 20 CR 117) is denied. The Court is very aware of the risk that detention facilities face when individuals become ill especially due to an infectious disease. Currently, and fortunately, the Kankakee jail has no confirmed cases of COVID-19. The Court checks daily to determine if this is the case. The Kankakee Correctional Facility has engaged in robust measures to ensure the safety of the pretrial detainees including not permitting outside visitors for the past 18 days, quarantining new admissions, and treating anyone with medical conditions. Defendant was detained as a danger to the community. The Court reviewed all of the submissions from the Defense counsel, the transcript of the hearing, and also the Government's submission. Defendant was arrested with numerous weapons and with drugs. The evidence contained within his apartment revealed not only possession but the manufacturing of drugs. There were scales, a money counting machine, cocaine base and cocaine collected in the search of his resident. A confidential informant informed the Court that Defendant has made statements in the past that law enforcement would not be able to catch him because if they entered his apartment he would kill them. During the search, loaded firearms were retrieved including a Draco that shoots multiple rounds which has an extended magazine with armor-piercing bullets. Defendant has six convictions which include the sale of drugs, the use of firearms, and assault on a law enforcement officer. There is a presumption that he be detained. In his submission, the only factor that he cites that would make him vulnerable to COVID-19 is his obesity. The Defendant's BMI is 37.3. The CDC does not list obesity as a risk factor, rather "severe obesity" which is defined by the CDC as greater than a BMI of 40. In short, based upon the strength of the evidence against him, the Defendant's extensive criminal history which includes crimes of violence and of drugs, the Court does not find that there are conditions of release that could be fashioned to allow for his release. He is a danger to the community and his obesity does not make him more susceptible to COVID-19 and there are no reported cases in his facility at this time.
