This morning Defendant filed an emergency motion seeking compassionate release from custody at FCI-Elkton [docket entry 586 on the emergency docket; docket entry 520 on the regular criminal docket in the underlying case, No. 13-cr-405-2]. That motion is taken under advisement. The Clerk may terminate the motion on the emergency docket. All further filings by counsel, as well as the Court's ruling, will be made on the regular criminal docket. According to the docket, in May 2013 Defendant was charged with several co-defendants with narcotics offenses. In August 2014, Defendant entered a guilty plea and in May 2015 Judge Guzman sentenced him to 200 months in prison. He began serving his sentence in May 2016 and has approximately nine years left before he is eligible for release. He is housed at FCI-Elkton, where there has been a severe outbreak of COVID-19 infection. Both the Attorney General of the United States and Judge Gwin, in Wilson v. Williams, No. 4:20-cv-794 (N.D. Ohio Apr. 22, 2020), have ordered that priority be given to evaluating inmates for possible transfer from that facility. Defendant states that he requested compassionate release from the Warden at FCI-Elkton on April 5, but has not yet received a response. Defendant does not expressly state whether his medical condition places him with the subclasses identified in Judge Gwin's order. Given these allegations, the Court sets a briefing schedule on the motion as follows: the Government is given until 5/4/2020 to file a response; Defendant is given until 5/6/2020 to file a reply. The Court will either issue a ruling by mail or set the matter for a hearing on 5/8/2020. The motion by Attorney LaCoulton Wells to appear as counsel 584 is granted; Attorney Wells is directed to file a revised appearance form as the form attached as docket entry 584 is blank.
