The Court previously advised him that in light of his recent release from custody, he had to either pay the remaining filing fee for this case ($350, as no deductions were made while he was in custody even though he had qualifying income) or submit an accurate and properly supported renewed IFP application with updated financial information. In response, Plaintiff submitted trust fund documents as directed but continues to representunder oaththat he is obtaining the basic necessities of life, including food and shelter, with no income, assets, or other means of support whatsoever. The Court declines to accept this facially improbable claim. In deciding whether to allow payment over time, the Court does not merely rubberstamp applications that omit required information as while it gives pro se litigants wide latitude, it will not overlook incorrect sworn information provided on forms designed to elicit basic financial information from individuals who are not represented by counsel. This, Plaintiff's renewed IFP applications 17 18 are denied without prejudice. In an exercise of its discretion, however, the Court will give Plaintiff a final chance to pay the $350 filing fee that he owes for this case or submit another IFP application that discloses how he is currently obtaining the necessities of life (for example, with public assistance, new employment, assistance from family, or other means). Answers such as "O," "unknown" or "N/A" or "not applicable" in response to questions will be deemed insufficient if they are inaccurate. If Plaintiff fails to comply by November 23, 2020, the Court may require him to pay the full fee before it will screen his amended complaint. The Clerk is directed to send Plaintiff a copy of this order, as well as a blank IFP application for non-incarcerated persons.
