- ilnd;;1:20-cv-02860_de23 RegisterActionDescriptionText "MINUTE entry before the Honorable John Z. Lee: Wells Fargo's motion for miscellaneous relief 19 is granted in part and denied in part. Rather than pay the filing fee, D8F5D7E has submitted an IFP application. But in a recent bankruptcy dispute between D8F5D7E and Wells Fargo, the Seventh Circuit rejected a materially identical IFP application. See D8F5D7E v. Wells Fargo Bank, N.A., 960 F.3d 976, 978 (7th Cir. 2020). In doing so, the Seventh Circuit held "that debtors in Chapter 13 cases cannot proceed on appeal in forma pauperis under § 1915, in the absence of extraordinary circumstances that we do not foresee." Id. Seeing no reason to depart from that logic here, the Court denies D8F5D7E IFP application without prejudice. By 7/21/20, D8F5D7E must either pay the filing fee or submit a revised IFP application describing "extraordinary circumstances" that justify allowing her to proceed IFP as a Chapter 13 debtor. Id. Otherwise, this case will be summarily dismissed. Wells Fargo's motion is therefore granted to the extent that it requests that the Court rule on D8F5D7E IFP application and denied to the extent that it requests that the Court hold a status hearing to do so. The briefing schedule 11 is stricken. The Court will set a new briefing schedule when and if D8F5D7E resolves her fee status. Mailed notice (ca, ) (Entered: 07/07/2020)" @default.
