- ilnd;;1:20-cv-02860_de27 RegisterActionDescriptionText "MINUTE entry before the Honorable John Z. Lee: The Court previously directed 21 Appellant D8F5D7E to either pay the filing fee or submit a revised in forma pauperis ("IFP") petition. In response to that order, D8F5D7E has filed an IFP application and letter 26 . The Court sympathizes with D8F5D7E based on the difficult financial circumstances she has encountered. Even so, the Court cannot grant the IFP application. As the Seventh Circuit explained in a recent case involving D8F5D7E, "Chapter 13 is designed for people who can pay most if not all of their debts." D8F5D7E v. Wells Fargo Bank, N.A., 960 F.3d 976, 977 (7th Cir. 2020). "To qualify for relief under Chapter 13," the court continued, "a person must have an income that enables her to pay most debts within five years." Id. at 978. But D8F5D7E IFP application indicates that she has no continuing source of income. Because that representation is inconsistent with D8F5D7E decision to proceed under Chapter 13, the IFP application must be denied. If D8F5D7E wants to move forward with this case, she must pay the filing fee by 7/30/20. Otherwise, this case will be dismissed. In the alternative, D8F5D7E may wish to seek relief under Chapter 7 of the Bankruptcy Code, which provides persons "without income" with a "fresh start." Id.
