- ilnd;;1:20-cv-03612_de20 RegisterActionDescriptionText "ORDER: On June 26, 2020, the Court denied Plaintiff's application for leave to proceed in forma pauperis (IFP) because it was incomplete. R. 6. As explained in the Court's June 26, 2020 order, Plaintiff's application did not provide answers to all of the questions and did not include certified trust fund information for the six-month period immediately preceding the filing of this lawsuit. Id. Plaintiff was given until July 27, 2020 to submit a renewed IFP application (or pay the full filing fee). Id. Instead, Plaintiff filed a motion to compel the MCC Chicago (where he is currently confined) to produce the "records" needed to complete the IFP application. R. 13. On September 9, 2020, the Court denied Plaintiff's motion because it provided no information as to when Plaintiff submitted his IFP application to prison authorities, and because MCC detainees regularly are able to obtain and submit trust fund information in connection with IFP requests. R. 14. Plaintiff was given until October 7, 2020 to submit a renewed IFP application (or pay the full filing fee). Id. Plaintiff subsequently submitted a renewed IFP application. R. 17 . The IFP application contains responses to all of the questions and appears to have been certified by a trust fund officer, id. at pgs. 12, but it does not include trust fund information for the six-month period immediately preceding this action (or, from about December 15, 2019 to June 15, 2020). Accordingly, the renewed IFP application, R. 17 , is denied without prejudice because it is incomplete. If Plaintiff wishes to proceed with this action, he must, by no later than December 9, 2020 submit a renewed, complete IFP application in accordance with this order and the prior orders of the Court. Any renewed application must include certified trust fund information for the relevant six month look-back period. If Plaintiff is unable to obtain the certified trust fund information, he must provide a written statement, supported by relevant documentation, showing his efforts to obtain the information. The Court makes this observation given the lack of trust fund information included in the current IFP application, coupled with Plaintiff's prior representations in his August 21, 2020 motion to compel, see R. 13, 14. Failure to comply by the aforementioned date will result in summary dismissal of this case. The Clerk is instructed to send Plaintiff a blank IFP application, along with a copy of this order.
