- ilnd;;1:20-cv-06264_de2 RegisterActionDescriptionText "EXECUTIVE COMMITTEE ORDER: On October 22, 2020, an Executive Committee Order was entered, directing that pro se litigant 93AC210 sign in upon arrival to the Dirksen U.S. Courthouse in Chicago, Illinois or the Roszkowski U.S. Courthouse in Rockford, Illinois and be escorted by a representative of the United States Marshals Service while he is in the Courthouse. Prior to the entry of the order, the Executive Committee was advised that Mr. 93AC210 had created a disturbance at the Clerk's Office Intake Desk on the 20th floor of the Dirksen U.S. Courthouse and was removed from the building. The Committee was further advised that on prior occasions, Mr. 93AC210 became verbally abusive during Court hearings, resulting in a judge's staff requesting the presence of a U.S. Marshals Service representative at Mr. 93AC210 future hearings. Since the entry of the October 22, 2020 order, the Executive Committee has learned that on October 30, 2020, Mr. 93AC210 passed through the screening entrance at the U.S. Dirksen Courthouse in Chicago, Illinois without presenting himself to sign in and be escorted as directed in the Executive Committee Order dated October 22, 2020. Mr. 93AC210 proceeded to the 20th floor District Court Clerk's Office, unescorted. The United States Marshals Service was notified. When United States Marshals Service representatives reached the 20th floor Clerk's Office, Mr. 93AC210 refused to leave on his own and was forcibly removed from the area. While being escorted from the 20th floor, Mr. 93AC210 struggled with Marshals Service representatives, biting a Court Security Officer. Ultimately, Mr. 93AC210 was charged in Cook County Circuit Court with aggravated battery to a government employee. The Executive Committee finds that due to his continued erratic behavior and failure to follow the October 22, 2020 order, there is sufficient cause for concern regarding Mr. 93AC210 conduct if he is not further restricted during his time in the Dirksen U.S. Courthouse in Chicago, Illinois or the Roszkowski U.S. Courthouse in Rockford, Illinois. Further, it is the judgment of the Executive Committee that reasonable and necessary restraints must be imposed upon Mr. Carver's ability to file new civil cases in this District pro se. Cases in existence prior to the entry of this order are not affected by the order and shall proceed as usual. Based upon 93AC210 conduct: IT IS HEREBY ORDERED THAT to maintain judicial security, 93AC210 will be permitted to enter the Dirksen U.S. Courthouse in Chicago, Illinois, or the Roszkowski U.S. Courthouse in Rockford, Illinois, only when he is ordered to do so by a judge of any Court to be physically present in the Courthouse for proceedings scheduled by a Court, and then he may enter the Courthouse no earlier than fifteen (15) minutes before the scheduled time of the proceedings. IT IS FURTHER ORDERED THAT upon entering the Courthouse, Mr. 93AC210 must first report to the officer at the lobby desk by identifying himself. He shall then identify the Court proceedings he is required to attend, naming the judge presiding over the matter before he will be allowed through the security check point in the Courthouse lobby. Mr. 93AC210 shall be accompanied in the Courthouse to and from the proceedings by a Deputy United States Marshal or another representative of the United States Marshals Service, and he must leave the Courthouse no later than five (5) minutes after his scheduled proceedings in Court are completed. IT IS FURTHER ORDERED THAT should Mr. 93AC210 have documents to submit, he shall mail them to the Courthouse or email them to Temporary_E-Filing@ilnd.uscourts.gov while allowed by General Order 20-0012. IT IS FURTHER ORDERED BY THE EXECUTIVE COMMITTEE in its capacity as the supervisor of the assignment of cases, that ------ 1) Mr. 93AC210, or anyone, other than an attorney acting on his behalf, is enjoined from filing any new civil action or proceeding in the United States District Court for the Northern District of Illinois without first obtaining leave by way of the following procedures: a) Any materials Mr. 93AC210, or anyone, other than an attorney acting on his behalf, wishes to submit for filing shall be forwarded to Room 2050, Office of the Clerk at the Courthouse in Chicago via U.S. Mail or via email to Temporary_E-Filing@ilnd.uscourts.gov. Only the Clerk or deputies specifically designated by the Clerk may receive such documents. b) Where the document submitted is a complaint, it shall be accompanied by a motion captioned "Motion Seeking Leave to File Pursuant to Order of Executive Committee." That motion shall, in addition to requesting leave to file the complaint, include a sworn statement certifying that the claims raised by or on behalf of Mr. 93AC210 in the complaint are new claims never before raised in any federal court. c) Whenever Mr. 93AC210 submits a document for filing, the clerk or designated deputy shall accept the papers, stamp them received, docket them on Mr. 93AC210 Executive Committee case number, and forward them to the Executive Committee. 2) The Executive Committee will examine any complaints submitted by or on behalf of Mr. 93AC210 to determine whether they should be filed. 3) If Mr. 93AC210 seeks leave to proceed in forma pauperis, the Committee will also determine if such leave should be granted. The Committee will deny leave to file any complaints if they are legally frivolous or are merely duplicative of matters already litigated. The Committee may deny leave to file any complaints not filed in conformity with this order. 4) If the Executive Committee enters an order denying leave to file the materials, the clerk shall retain the order on a miscellaneous docket with the title "In Re: Marva Crowder" and cause a copy of the order to be forwarded to Mr. 93AC210. 5) If the Executive Committee enters an order granting leave to file the materials, the clerk will cause the materials to be stamped filed as of the date received and shall cause the case to be assigned to a judge in accordance with the rules. The clerk shall also cause a copy of the order to be forwarded to Mr. 93AC210. 6) Mr. 93AC210 failure to comply with this order may, within the discretion of the Executive Committee, result in his being held in contempt of court and punished accordingly. 7) Nothing in this order shall be construed ----- a) to affect Mr. 93AC210 ability to defend himself in any criminal action, b) to deny Mr. 93AC210 access to the federal courts through the filing of a petition for a writ of habeas corpus or other extraordinary writ, or c) to deny Mr. 93AC210 access to the United States Court of Appeals or the United States Supreme Court. IT IS FURTHER ORDERED That any password issued to 93AC210 for access to the electronic filing system shall be disabled. IT IS FURTHER ORDERED That any new complaints filed by Mr. 93AC210 and transferred to this Court from another jurisdiction shall be reviewed by the Executive Committee to determine whether they should be filed. IT IS FURTHER ORDERED That the Clerk shall cause a copy of this order to be mailed to Mr. 93AC210 at 16438 Woodlawn West Ave., South Holland, Illinois 60473, the address provided in documents filed on September 30, 2020. Such mailing shall be by certified or registered mail, return receipt requested.
