- ilnd;;1:20-cv-07821_de6 RegisterActionDescriptionText "MINUTE entry before the Honorable John J. Tharp, Jr: Upon review of the defendant's notice of removal from the Circuit Court of Lake County 1 , the parties are directed to file briefs addressing whether this Court has subject matter jurisdiction over this matter in light of Seventh Circuit precedent establishing that the domestic relations exception, which "denies federal jurisdiction to... exercise the other characteristic powers of a domestic-relations court," Jones v. Brennan, 465 F.3d 304, 306 (7th Cir. 2006), applies in both federal question and diversity jurisdiction cases. See, e.g., Weinhaus v. Cohen, 773 F. App'x 314, 316 (7th Cir. 2019). The parties are also directed to address whether Plaintiff 666E9F1 Marriage Settlement Agreement with the decedent is a "qualified domestic relations order" pursuant to 29 U.S.C. § 1056(d)(3) and, if so, what impact (if any) that determination has on this Court's subject matter jurisdiction. See Metropolitan Life Ins. Co. v. Wheaton, 42 F.3d 1080, 1082-83, 1085 (7th Cir. 1994). The parties' briefs are due on 1/22/2021. Mailed notice (air, ) (Entered: 01/05/2021)" @default.
