Therefore, the following is a detailed summary of todays proceeding: Counsel for defendant and the government stated their consent to todays conference proceeding by video/telephone. The government advised the court that it has been providing discovery to defense counsel and wishes to place the defendant in Trial Group IV. Defense counsel indicated he had met with his client and needed additional time to review discovery. Defense counsel also stated that the defendant had no objection to being placed at this juncture in Trial Group IV. Defense counsel also agreed to the exclusion of time under the Speedy Trial Act until January 4, 2021. The Court confirmed with the defendant that he consented to that date and the exclusion of time. Although time had already been excluded for Trial Group IV until January 4, 2021, the Court again found that the exclusion of time is warranted because of (1) the complex case designation assigned to Group IV, and (2) the need for various defendants in Group IV to complete the death penalty protocol and for defendant 40749DE to have time to review discovery with his counsel and decide how he wishes to proceed. The Court specifically stated that the time until January 4, 2021 is excluded under the Speedy Trial Act because, for the above-referenced reasons, the ends of justice served by granting this continuance outweigh the best interests of the public and the defendants in this trial group in a speedier trial. 18 U.S.C. § 3161(h)(7)(A). The Court also noted that, once defense counsel for Eduardo 40749DE indicated that his client was ready to proceed with setting a motion schedule or a trial date, the Court would sever the defendant from Trial Group IV if theother defendants were not ready to proceed. The government asked whether the defendant wanted the government to make consular notification and defense counsel indicated that he would send a written letter to the government if he wished such notification to be made.
