The Court is troubled that Plaintiffs' lead counsel filed a Motion for Preliminary Injunction and nonetheless made (or did not change) travel plans that might interfere with a prompt hearing on that Motion. In any event, three attorneys have entered their appearances on behalf of Plaintiffs. One of those attorneys' inability to proceed on February 15, 2017 is not good cause to reset the hearing. In addition, the Court set the February 15 hearing date specifically so it could enter a written order on the Motion no later than February 17, given that the Court has a two-week criminal trial beginning on February 21, 2017. As a practical matter, therefore, if the hearing does not proceed on February 15, the earliest it could be rescheduled on the Court's docket would be the week of March 6. Finally, in their Motion for Preliminary Injunction, Plaintiffs challenge Regulation 50's seven-day advance notice requirement for obtaining a permit to engage in what they believe to be expressive activities protected by the First Amendment at the Jeppesen Terminal. Plaintiffs further argue in their Motion that they seek to "engage in First Amendment expression in quick response to topical events," and that they are specifically seeking a preliminary injunction to guarantee their right to engage in protected expression as part of "a time-sensitive response to a nearly unprecedented action by our federal government." Motion at 15, 21. Seeking to delay access to the Court's limited judicial time and resources would not appear to further Plaintiffs' objectives. Accordingly, notwithstanding the unopposed nature of the Motion, it is DENIED for lack of good cause shown.
