- ctd;;3:17-cv-00732_de15 RegisterActionDescriptionText "SCHEDULING ORDER: The Court has reviewed the parties' Rule 26(f) Planning Report (Doc. # 13 ) and declines to adopt the parties' proposed dates. This case primarily involves a claim of false arrest by a police officer, along with conclusory allegations of municipal Monell liability against the City of Bristol and its chief of police. See Adams v. City of New Haven, 2015 WL 1566177 (D. Conn. 2015) (dismissing similarly conclusory Monell claim). The parties' report states that they will need to conduct 3 to 4 depositions each and that they may have expert testimony (but without describing the reason why expert testimony would be required). The parties propose to conclude fact discovery by August 15, 2018, to conclude expert discovery by December 15, 2018, and to file dispositive motions by January 15, 2019. All these dates are far too prolonged in light of the apparent simplicity of this case involving a discrete claim of false arrest. The Court concludes that the parties can reasonably complete discovery within 8 months and file any dispositive motions within 9 months. All discovery shall be completed by February 1, 2018. Dispositive motions shall be filed by March 1, 2018. The parties shall file a joint trial memorandum on the later of the following dates: within 30 days of the close of discovery or within 30 days of the Courts ruling on any dispositive motion. The case shall be trial-ready within 30 days of the filing of the joint trial memorandum. If there is any plausible basis for Monell liability or for expert testimony, then the parties may move for an extension of time to complete discovery. Any such motion should describe with particularity why the parties cannot meet the current scheduling order and must detail the proposed additional discovery that will be necessary and that cannot be accomplished within the 8-month discovery period. The parties are encouraged to promptly begin discovery, because the Court is unlikely to extend these dates absent extraordinary and unforeseeable reasons.
