- flsd;;9:17-cv-80742_de10 RegisterActionDescriptionText "PAPERLESS ORDER granting 10 Motion for Extension of Time to File Response/Answer to a Complaint or Other Case Initiating Document Department of Corrections. Answer due 9/13/2017 to Re: 1 Application/Petition (Complaint) for Writ of Habeas Corpus filed by D932ADE in compliance with this court's show cause order. The respondent is directed to ensure that it may raise any procedural defenses, but shall address the merits of the claims in the alternative in order to not further belabor resolution of this matter. The respondent is also directed to ensure that its appendix contains a complete record of all state court proceedings, paying particular attention to the trial, sentencing, and any evidentiary Rule 3.850 transcripts, as well as, any post-conviction motions that are relevant to the issues before this court, together with all responses and orders thereon, in addition to any and all briefs on appeal, whether on direct appeal or following an appeal of post-conviction proceeding, and any state habeas corpus petitions and resolution thereof, as well as, a copy of the state criminal docket, and any and all appellate court dockets, and supreme court dockets. The respondent is reminded that its appendix should not merely attach in haphazard form the state court record on appeal, but should be in chronological order, with the trial and sentencing transcripts being filed separately. Further, the respondent shall not cause unnecessary duplicative filings to be attached to each state court pleading. The respondent shall ensure that it's response to the show cause order together with its appendix are filed simultaneously on or before September 13, 2017. NO FURTHER EXTENSIONS will be granted absent extraordinary circumstances which may require a show cause hearing. The respondent is reminded that this court has been generous with the deadlines required under the local and federal rules regarding federal habeas petitions in order to avoid unnecessary and unwarranted delay in resolution of habeas petitions. Signed by Magistrate Judge Patrick A. White on 8/14/2017. (nn) (Entered: 08/12/2017)" @default.
