- ilcd;;4:16-cv-04111_de10 RegisterActionDescriptionText "TEXT ORDER Entered by Judge Colin Stirling Bruce on 6/10/16. Plaintiff files 4 , a Motion to proceed in forma pauperis. The Plaintiff was not in custody at the time he filed his complaint so the Prisoner Litigation Reform Act does not apply to his case. Requests to proceed IFP are reviewed under 28 U.S.C. Section 1915. The federal in forma pauperis statute is designed to ensure indigent litigants meaningful access to the federal courts. Neitzke v. Williams, 490 U.S. 319, 327 (1989). The court must deny an IFP request, however, if : (1) the allegation of poverty is untrue; (2) the action is frivolous; (3) the action fails to state a claim; or (4) the action seeks monetary relief against an immune defendant. 28 U.S.C. §1915(e)(2); see also Hutchinson v Spink, 126 F.3d 895, 899 (7th Cir. 1997)(recognizing the applicability of §1915 to cases brought by nonprisoners); Franklin v Metro East Sanitary District, 2014 WL 103901 at 1 (S.D. Ill. Jan. 10, 2014)(applying §1915(e)(2) to nonprisoner). The Plaintiff states his only income is a monthly allotment of food stamps. While the Plaintiff is still ultimately responsible for payment of the filing fee, the court finds the Plaintiff is not able to pay the filing fee in full. 4 is GRANTED.
