The motion must meet the screening standard in 28 U.S.C. § 1915(e)(2)(B)(i), which provides for the dismissal of "frivolous" in forma pauperis cases. See Vey v. Clinton, 520 U.S. 937, 937 (1997). Section 1915(e)(2) applies to all litigants who seek to proceed in forma pauperis, not just prisoners. See e.g., Schottler v. Wisconsin, 388 Fed.App'x. 547, 547-548 (7th Cir. 2010) (affirming dismissal under 28 U.S.C. § 1915(e)(2)(B)(i) for a plaintiff that is not a prisoner); Vey, 520 U.S. at 937 (same); McDowell v. Eden, 2011 WL 196937, *1 (N.D. Ill. Jan. 20, 2011) (same). In addressing any pro se litigant's complaint, the Court must construe the complaint liberally. Haines v. Kerner, 404 U.S. 519, 521 (1972). The Court will grant leave to proceed if there is an arguable basis for a claim in fact or law. Neitzke v. Williams, 490 U.S. 319, 325 (1989). But dismissal of the complaint is the proper course where it is clearly baseless or fanciful. Denton v. Hernandez, 504 U.S. 25, 32-33 (1992). Here, the complaint is difficult to understand. On the one hand, the form complaint is the one used for employment discrimination cases, but the short narrative of facts describes a murder. R. 1. The complaint also states that the plaintiff is a Cynthia Humphrey, but of course the complaint caption lists Terry Todd as the plaintiff. It does appear, from online news articles, that Ms. Humphrey was indeed stabbed in the manner re-stated in the complaint. The civil cover sheet checks-off boxes for ERISA, diversity jurisdiction, and describes the cause of action as "wrongful death." R. 2. As currently drafted, the complaint does not state a coherent claim. In order to clarify the cause of action, and to clarify what relationship Plaintiff Todd has to Ms. Humphrey, Plaintiff may file an amended complaint on or before 02/13/12, accompanied by another motion to proceed in forma pauperis. Failure to file an amended complaint will result in dismissal of the case. The motion to appoint counsel [R. 4 ] is also denied without prejudice in light of this ruling, and the Court also notes that the motion would have been denied in any event because Plaintiff contacted only 1 attorney before filing the motion; if Plaintiff intends to re-file the appointment motion, he should contact at least two others before re-filing.
