Plaintiffs inspection of the OPR files shall proceed in accordance with the court orders entered on 10/31/18 and 11/16/18 after status hearings held on 10/30/18 and 11/15/18, respectively [ 297 , 302 ]. The court order entered on 10/31/18 memorializing the 10/30/18 status hearing states as follows: Defendant Dart will make available to Plaintiff the 175 OPR files he has agreed to make available for review no later than 11/20/18. Plaintiff will review the records in accordance with the agreed parameters that the parties have worked out themselves 297 . Counsel for both parties referenced the agreed upon parameters at the 10/30/18 status hearing. The Court subsequently extended the 11/20/18 date to 11/27/18 on 11/15/18 on Plaintiffs motion and without objection by any Defendant 302 . The parties appear to have agreed the inspection will occur on 11/26/18 and 11/27/18. The Court does not know what motivates Defendants Dart and the Cook County Sheriffs Office to insist that Plaintiff bring 4 people rather than 6 people to an inspection that Defendants want to limit to 2 days but Plaintiffs counsel appears to have implicitly agreed to those limitations (or even expressly agreed to them, according to Defendants) in telephone conversations, by not responding to Defendants counsels letter of 10/30/18 memorializing the agreed upon parameters for the inspection [ 306-1], and by acknowledging the parties had agreed to parameters for the inspection in open court on 10/30/18 297 . Plaintiffs counsel now appear to want to ignore any discussion or agreement reached concerning the parameters for their inspection of the OPR files and say they will try to complete the inspection in two days but they cannot promise they will be able to do so without seeing the files. Defendants say they only agreed to the inspection if it could be completed in two days. The Court, of course, ultimately has the authority to prescribe the terms under which the inspection will take place whether or not the parties agree. Therefore, if it is necessary for the Court to adjust the dates or the protocol for the inspection, it can do so taking into account everything the parties have said in their filings concerning Plaintiffs Motion [ 305 , 306 ] and any other relevant considerations. The Court sees no reason to do so now, however. The inspection shall proceed on 11/26/18 and 11/27/18 in accordance with the terms of Defendants 10/30/18 letter [306-1] unless the parties mutually agree to modify those procedures.
