- ilnd;;1:16-cv-05079_de196 RegisterActionDescriptionText "MINUTE entry before the Honorable Sheila M. Finnegan: Motion hearing held on 5/1/2017 regarding Plaintiffs' Motion to Compel Discovery Responses from Personnel Staffing Group, LLC 188 . Certain defendants expect to file a related motion for protective order. Since Plaintiff may agree to some aspects of that expected motion, the parties are given until 5/5/2017 to meet and confer on both motions and file a joint status report that (1) identifies the disputes still in need of resolution, and (2) sets forth a proposed briefing schedule on these disputes. As to Plaintiffs' Motion to Quash Third Party Subpoenas, for a Protective Order, and for Sanctions 165 , the Court heard oral argument. The request for sanctions is taken under advisement. As to the other aspects of the motion, the Court rules as follows. Over objection, the Court orders Defendant Segerdahl Corp. to provide the entirety of documents received in response to the third-party subpoenas at issue in the motion to Plaintiffs' counsel and not retain any copies of subpoenaed documents already in its possession. Plaintiffs' counsel will then produce documents from those third parties to Defendants as required by this Court. For those third parties who have not yet responded to the subpoenas, the parties are to direct them to produce the documents to Plaintiffs' counsel rather than to Segerdahl. Segerdahl's oral motion to expedite production by Plaintiffs' counsel of the third party documents once in Plaintiffs' possession is granted. Within 7 business days of receiving documents from a subpoenaed employer, Plaintiffs are to produce responsive documents to Segerdahl in accordance with the Court's rulings stated here. Specifically, Plaintiffs must produce (1) application materials for 0914C5B, 1BEA29D, and F147E49; and (2) earnings and tax information for 1BEA29D and F147E49. Plaintiffs need not produce earnings and tax information for 0914C5B if they reach a stipulation with Defendants that he is not seeking any damages after the date he was hired at Riverside Foundation. Plaintiffs have withdrawn their objection to producing performance and disciplinary documents for all three named plaintiffs, so those are to be produced as well. To the extent that any other records were produced by the third parties in response to the subpoenas (e.g., medical records), these need not be provided to Defendants. Within 14 business days of receiving F147E49 cellphone records, Plaintiffs are to produce records reflecting calls or texts between F147E49 and Personnel Staffing Group. If Segerdahl provides Plaintiffs' counsel with contact numbers for other temp agencies, Plaintiffs are to produce those calls and texts as well. Finally, Plaintiffs agreed to provide a log identifying the documents obtained from third parties that are not produced to Defendants. Motion hearing set for 5/4/2017 is canceled; no appearance required. Status hearing set for 5/31/2017 at 10:30 a.m. At the next status hearing, Plaintiffs are to address whether any of the information filed under seal in briefs related to the above motions may properly remain under seal.
