- ilnd;;1:17-cv-00302_de8 RegisterActionDescriptionText "MINUTE entry before the Honorable Matthew F. Kennelly: The complaint in this case, which was filed in federal court based on diversity of citizenship, does not completely or adequately describe the citizenship of any of the parties. First, as to the individual plaintiff and individual defendant, the complaint identifies only their states of residence, not their states of citizenship. The two are not necessarily the same. Second, the complaint does not describe the citizenship of the LLC defendant or that of any of its members, some of which are alleged to be LLCs. The citizenship of an LLC is that of each of its members; it does not depend on the place where the LLC was organized or has its principal place of business. See Mutual Assignment & Indemnification Co. v. Lind-Waldock & Co., LLC, 364 F.3d 858, 861 (7th Cir. 2004); Cosgrove v. Bartolotta, 150 F.3d 729, 731 (7th Cir. 1998). Plaintiff is given until 3/2/2017 to file an amended complaint that corrects these defects. If plaintiff fails to do so, the Court will dismiss the case for lack of subject matter jurisdiction.
