- ilnd;;1:20-cv-00658_de44 RegisterActionDescriptionText "MINUTE entry before the Honorable John F. Kness: Under Second Amended General Order 20-0012 ("IN RE: CORONAVIRUS COVID-19 PUBLIC EMERGENCY"), entered on March 30, 2020 by Chief Judge Rebecca R. Pallmeyer, all civil case hearings in the Northern District of Illinois are stricken and will be reset to a date on or after May 4, 2020. In the present case, the parties are currently scheduled to appear at a status hearing on April 9, 2020 at 9:45 a.m.; in addition, an evidentiary hearing on Plaintiff's anticipated written motion for a preliminary injunction is scheduled to begin on April 14, 2020 and conclude on April 15, 2020 (as needed). In the light of Second Amended General Order 20-0012, both the April 9 and April 14-15 hearing dates are stricken. Although these hearing dates are stricken, the Court recognizes that the existing Temporary Restraining Order expires on April 14, 2020, and the Court does not construe the current expiration date as being subject to extension under the terms of Second Amended General Order 20-0012. That expiration date was, however, entered in the Court's anticipation that the appropriateness of continued injunctive relief would be informed by the evidence and argument presented at the now-stricken April 14 evidentiary hearing. Accordingly, if Plaintiff intends to seek either a continuation of the existing TRO beyond April 14, 2020, or a new preliminary injunction to begin on or after April 14, 2020, Plaintiff must file a motion for emergency relief under the procedures set forth in Paragraphs Five and Six of Second Amended General Order 20-0012. Among other things, that procedure requires that any emergency motion be filed both in Case No. 20-cv-01792, which is a special docket created to receive emergency motions filed during the pendency of Second Amended General Order 20-0012, and on the docket in this case. (Counsel are encouraged to review all of Second Amended General Order 20-0012 carefully to ensure proper compliance with its terms.) Finally, regardless of whatever developments may occur with respect to any emergency request for continued injunctive relief, the Court anticipates setting an in-person status hearing shortly after the resumption of regular Court operations. Mailed notice (Kness, John) (Entered: 04/05/2020)" @default.
