Donnelly referred plaintiffs' motion for a default judgment, ECF No. 37 , to me for a Report & Recommendation pursuant to 28 U.S.C. § 636(b). For the reasons set forth in the attached Report & Recommendation, it is respectfully recommended that plaintiffs' motion for a default judgment should be granted in part and denied in part. The Court should grant a default judgment on plaintiffs' breach of contract claim and award $150,000 in damages, jointly and severally, against the Chen defendants. Plaintiffs should also be awarded post-judgment interest on all sums awarded from the date the Clerk of Court enters judgment until the date of payment. Additionally, plaintiffs should be awarded $550 in costs. Plaintiffs' motion for a default judgment seeking damages for fraud as well as plaintiffs' motion for a default judgment against defendant Lai Lai, Inc. on their unjust enrichment claim should be denied. Plaintiffs are hereby ordered to serve a copy of this Report upon defendants at their last known addresses and to file proof of service with the Court forthwith. Pursuant to 28 U.S.C. § 636(b)(1) and Federal Rule of Civil Procedure 72(b)(2), the parties shall have fourteen days from service of this Report to file written objections. See attached Order.
