James Otero: The Court is in receipt of (1) Defendants xTV Networks, Ltd. and xTV Networks US,Inc.'s Motion to Dismiss Plaintiff's First Amended Complaint ("Motion"), filed April 26,2016; (2) Plaintiff Activision Publishing, Inc.'s Opposition thereto; and (3) Plaintiff'sNotice of Recent Federal Circuit Authority in support of its Opposition. (See ECF Nos.27-29.) In light of (1) the nascency of this litigation; (2) the fact that a scheduling conference is set for July 5, 2016, during which the Court wishes to have the parties present technology tutorials; and (3) the possible importance of the Enfish v. Microsoft et al. opinion to the Section 101 component of Defendants' Motion, the Court will defer ruling on Defendants' Motion until after the scheduling conference is held. Therefore, the May 31, 2016 hearing date for Defendants Motion is vacated.During the scheduling conference, the Court wishes to have the parties provide a technology tutorial and overview of likely contested and potentially dispositive issues, including the Section 101 issue raised in the Motion. (SEE DOCUMENT FOR SPECIFICS). The Court also wishes to have the parties submit supplemental briefs, not to exceed five (5) pages in length, regarding the relevance of the Enfish opinion. Defendants shall file their supplemental brief on or before June 6, 2016, and Plaintiffs shall file their responsive brief on or before June 13, 2016.
