In light of General Order 20-09, and the closure of the Court to the public due to health concerns arising from the pandemic, the Court confers with counsel about how to conduct the bench trial. The Court states that it could be done by videoconference at this time, or in person once the courthouse re-opens for civil matters. Plaintiffs counsel prefers to proceed in-person and suggests a postponement to mid-February 2021, or later, given Ms. Beverlin's anticipated leave. Defense counsel prefers the bench trial proceed this year in person if the courthouse has reopened for civil matters, and potentially by videoconference, if it has not. Defense counsel requests a further status conference in approximately one month to discuss the status of the pandemic and likelihood that the courthouse will reopen relatively soon. The Court sets a Telephonic Status Conference for 9/22/2020 at 10:00 AM. Counsel are ordered to meet and confer and file a Joint Statement by September 17 stating their respective and/or collective views regarding how best to proceed with the bench trial, given the circumstances present at that time, and including the dates counsel and the witnesses are available in October and November.
