After a review of the parties' written submissions and hearing the parties' arguments, and for the reasons discussed during the conference, Plaintiff is ORDERED, by no later than 5:00 PM on September 26, 2018, to amend her disclosure of treating physician Dr. E089907, D.O. as an expert witness pursuant to Federal Rule of Civil Procedure 26(a)(2)(A) so that the disclosure sets forth "(i) the subject matter on which the witness is expected to present evidence under Federal Rule of Evidence 702, 703, or 705; and (ii) a summary of the facts and opinions to which the witness is expected to testify" in accordance with Federal Rule of Civil Procedure 26(a)(2)(C). Plaintiff's amended disclosure shall be served on Defendant and submitted to the Court via email at SKOorders@caed.uscourts.gov. The Court DEFERS ruling on Defendants objection to Plaintiffs attempt to depose Dr. E089907 until after the Court reviews Plaintiff's amended disclosure and determines whether it complies with the Federal Rules of Civil Procedure. With respect to the availability of Plaintiff's retained expert witness Dr. Thomas Margolis for deposition on November 3, 2018, after the close of expert discovery on October 9, 2018, Plaintiff's counsel SHALL, by no later than September 28, 2018, re-contact Dr. Margolis in an attempt to obtain his availability for deposition prior to the close of discovery and shall advise Defendant's counsel of the availability of Dr. Margolis as soon as is practicable. In addition, the parties are ORDERED to meet and confer as to the feasibility of holding the settlement conference on October 11, 2018, and, if not feasible, SHALL propose continued settlement conference dates to the Court by no later than September 28, 2018, signed by Magistrate Judge Sheila K.
