- caed;;2:16-cv-02632_de43 RegisterActionDescriptionText "MINUTE ORDER issued by Courtroom Deputy C. Schultz for District Judge Kimberly J. Mueller: On August 11, 2017, the court denied Plaintiffs' request to seal documents they intended to file with their motion for class certification. ECF No. 37 . The court denied the request without prejudice to refiling of a properly supported request by Defendant Ball. Id. On August 18, 2017, Plaintiffs filed an identical request to the one the court denied. ECF No. 38 . The court again DENIES the request. This court's standing order provides as follows: "The court will only consider requests to seal or redact filed by the proponent of sealing or redaction. If a party plans to make a filing that includes material an opposing party has identified as confidential and potentially subject to sealing, the filing party shall provide the opposing party with sufficient notice in advance of filing to allow for the seeking of an order of sealing or redaction from the court." ECF No. 4-1. Here, Plaintiffs ask to seal a document, but it is clear that Defendant is true proponent of the seal, and Plaintiff's request thus violates the court's standing order. In addition to denying the request, the court also Orders Plaintiffs to SHOW CAUSE, within seven (7) days, why the court should not issue monetary sanctions in the amount of $250 for failure to comply with the standing order as well as the court's recent order denying their previous, identical request.
