The Government shall disclose an updated witness list and exhibit list to defendant by January 16, 2017, and shall ensure by that date that any other Brady/Giglio and 404(b) evidence has been disclosed. The Government's witness/exhibit lists shall indicate whether a witness/exhibit is "likely" or "possible" to be called or used. The parties shall file their trial memoranda, voir dire, jury instructions and any motions in limine by January 19, 2017; jury selection to proceed at 8:30am on February 2, 2017. The Court is highly unlikely to grant a further continuance of jury selection. For Speedy Trial Act purposes, I hereby exclude the time from today to the new date set for jury selection. I conclude that the ends of justice served by taking such action outweigh the best interest of the public and the defendant in a speedy trial as that term is defined under the Speedy Trial Act, and in making this finding I have specifically considered each of the factors set forth in 18 USC § 3161(h)(7)(B), and here I specifically and primarily rely on defense counsel's good faith representations about the time that is reasonably needed in this matter.
