Plaintiff's 106 First Motion to Compel Responses to Deposition Questions states: "Filed herewith, is an Affirmation by counsel for the Plaintiff, certifying that he has conferred with counsel for the opposing party in good faith efforts to resolve by agreement the disclosure of the following discovery without intervention of the Court, and has been unable to reach such an agreement." Doc. # 106 at 1. However, no such Affirmation has been filed. Accordingly, on or before the close of business on May 15, 2019, counsel for plaintiff shall file his affirmation regarding his meet and confer efforts with opposing counsel. That affirmation must comply with the Local Rules, which require counsel making the motion to confer "in person or by telephone, with opposing counsel and discuss[] the discovery issues between them in detail in a good faith effort to eliminate or reduce the area of controversy, and to arrive at a mutually satisfactory resolution." D. Conn. L. Civ. R. 37(a) (emphasis added). Failure to file the affirmation may result in the denial of plaintiff's 106 motion to compel, without prejudice to re-filing. Additionally, in light of the July 30, 2019, summary judgment deadline (Doc. #100), and the possible need for additional deposition testimony following the Court's ruling on plaintiff's 106 motion to compel, plaintiff's reply brief, if any, shall be filed on or before the close of business on May 17, 2019.It is so ordered.
