The Court's Scheduling Order in this case states that "[d]iscovery shall commence upon service of the Complaint..." [DE 6.] The Complaint was served on November 8, 2016. [DE 8.] Thus, Plaintiff has had over three months to conduct what should be relatively straightforward discovery. That defense counsel was unavailable for four days of this period due to a trial in another case is not evidence that Plaintiff has been unable to complete discovery by the Court's deadline despite his diligence.
