On April 1, 2016, this Court entered a Notice of Court Practice in Fair Labor Standards Act Cases 5 requiring the Parties hold a settlement conference within twenty (20) days after the date the Defendant's Response was due, or no later than fifty-five (55) days after the filing of the Notice of Court Practice 5 . The parties were then to file a Joint Scheduling Report within fourteen (14) days of the Settlement Conference. The Notice cautioned, "[n]on-compliance with any provision of this Order, the Federal Rules of Civil Procedure, and/or the Local Rules of Court, may subject the offending party to sanctions or dismissal." The deadline for conducting a settlement conference and submitting a joint scheduling report has passed and no extension of time has been requested. Accordingly, based on the foregoing, it is ORDERED AND ADJUDGED that this action is DISMISSED WITHOUT PREJUDICE. The Clerk of the Court is instructed to CLOSE this case. All pending motions are DENIED AS MOOT. The Parties may move to reopen this matter upon filing a joint scheduling report no later than June 17, 2016. Signed by Chief Judge K.
