See ECF No. 844 at PageID #8799. Defendant did not provide a status report about redactions, but instead provided argument on an unrelated matter. Accordingly, Defendant's status report, ECF No. 843 , is hereby STRICKEN, for failure to comply with the court's request for an update of the parties' negotiations regarding redaction. Further, upon review of the relevant briefing on the issue of redactions, the court hereby DENIES the Government's emergency motion to seal, ECF No. 771 , and instructs the Clerk of Court to unseal ECF Nos. 768 and 800 -1. The Government argues that certain information was provided to Defendant in a March 2, 2020 letter containing confidential information. See ECF No. 844 at PageID #8799. However, the information which the Government seeks to redact, and which Defendant quotes in ECF Nos. 768 and 800 -1, is publicly available. See Crandall-Slafsky v. Dept. of the Treasury, 2019 WL 5870217 (Nov. 5, 2019). And such information, while not germane to the underlying motion, may be relevant to Defendant's arguments going forward. Accordingly, a protective order is not appropriate at this time. To be clear, Defendant is allowed to rely on information that is publicly available that is, she may not rely on information that is only available confidentially. To the extent the parties intend to rely on confidential and non-public information going forward in future filings, they may seek a protective order at that time, consistent with the Local Rules.
