However, if the Plaintiff did NOT intend to file a lawsuit, he may inform the Court IN WRITING on or before January 20, 2016 and the Court will dismiss the lawsuit without accessing a filing fee. If the Plaintiff DID intend to open a lawsuit, he MUST either pay the $400 filing fee or file a motion to proceed in forma pauperis on or before January 20, 2016. The Plaintiff may also wish to file an amended complaint. The Clerk of the Court is to provide the Plaintiff with a blank complaint form and ifp form. If the Plaintiff does not respond on or before January 20, 2016, the Court will assume the Plaintiff did intend to open a lawsuit and the Plaintiff will be responsible for the $400 filing fee, even if his case is later dismissed.
