- ilcd;;1:16-cv-01024_de300 RegisterActionDescriptionText "TEXT ORDER entered by Judge Harold A. Baker on 4/16/2018. Plaintiff has filed a 109-page response to Defendants' motion for summary judgment, with an additional 724 pages of attachments. Plaintiff identifies as "Undisputed Material Facts" that the Defendant 327C921 told him "you don't deserve the air you breathe"; that Defendant 0525C7E attempted to discredit him; that Defendant 0525C7E lied to his superiors, etc. These "undisputed" facts start at page 12 and continue through page 89. Plaintiff thereafter attaches a 20- page affidavit making further allegations that Defendants did not provide him adequate care and that Defendant 327C921 obstructed his medical treatment and tampered with medication orders. While identified as an affidavit, it really consists of yet additional argument and inference, as well as irrelevant information outlining Plaintiff's medical care since 1997. CDIL-LR 7.1(D)(5) provides that the Argument portion of a response to summary judgment may not exceed 15 typewritten pages. Here, Plaintiff has submitted a combination of handwritten and typed pages which, including the affidavit, are approximately 90 pages. "Enforcing page limits and other restrictions on litigants is rather ordinary practice. This court has a page limit which is rather strictly, and cheerfully, enforced." Watts v. Thompson, 116 F.3d 220, 224 (7th Cir. 1997). Plaintiff's response and affidavit 233 are STRICKEN. Plaintiff will have 14 days in which to file a response in conformity with the local rules. Plaintiff need not refile his 724 pages of attachments. (JMB, ilcd) (Entered: 04/16/2018)" @default.
