- ilcd;;1:16-cv-01024_de71 RegisterActionDescriptionText "TEXT ORDER entered by Judge Colin Stirling Bruce on 10/11/2016. Plaintiff files 50 , a Motion to Reconsider the Court's Merit Review Order 31 . Plaintiff claims that defendants 39A8E25 and Funk should not have been dismissed because he sent them letters apprising them of his complaints. Plaintiff fails, however, to allege that these defendants are personally liable for his claimed injury. There is no respondeat superior liability under Sec 1983 Palmer v. Marion County, 327 F.3d 588, 594 (7th Cir. 2003). See also, Diaz v. McBride, 1994 WL 750707, at *4 (N.D. Ind. Nov. 30,1994) (holding that a plaintiff could not establish personal involvement, and subject a prison official to liability under section 1983, merely by sending the official various letters or grievances complaining about the actions or conduct of subordinates.) Burks v. Raemisch, 555 F.3d 592, 595 (7th Cir. 2009) ("no prisoner is entitled to insist that one employee do another's job"). Thus, a supervisory official must be personally involved in the alleged conduct to be liable. Plaintiff also disputes the Court's dismissal of Defendant 7D57A4B. Plaintiff claims that Defendant 7D57A4B ignored and failed to investigate his grievances. This, however, is not sufficient to render this defendant personally liable for the complaint of conduct. "[T]he alleged mishandling of [Plaintiff's] grievances by persons who otherwise did not cause or participate in the underlying conduct states no claim." Owens v. Hinsley, 635 F.3d 950, 953 (7th Cir. 2011). Plaintiff also objects to the Court's dismissal of the unrelated, misjoined claims. The complaint, however, evidences an impermissible attempt by Plaintiff to throw all his grievances into one stewpot. See Wheeler v. Wexford Health Sources, Inc., 689 F.3d 680, 683 (7th Cir. 2012); see also George v. Smith, 507 F.3d 605, 607 (7th Cir. 2007) ("[u]nrelated claims against different defendants belong in different suits[.]"). If Plaintiff wants to bring these various unrelated causes of action, he must pay the required filing fees. 50 is DENIED. (KE, ilcd) (Entered: 10/11/2016)" @default.
